Yes — for most planning applications in England since April 2024 under the Environment Act 2021, requiring a minimum 10% biodiversity net gain over the pre-development baseline. From 6 August 2026, a new area-based exemption applies: development sites of 0.2 hectares or less (around 2,000 m²) no longer need to demonstrate 10% BNG, provided no priority habitat is present on site. The exemption does not apply where priority habitat is affected, and protected species law and local plan policy still apply regardless. Applications submitted before 6 August 2026 are assessed under the previous rules. The existing de minimis threshold (under 25 m² of habitat) also still applies. Scotland and Wales are developing their own frameworks. Confirming that usually needs a habitat check or Preliminary Ecological Appraisal (PEA) by an ecologist, so "exempt" is rarely automatic. Being exempt from BNG also does not remove the need to address protected species (bats, newts, nesting birds) or local plan policy, and many applications still require a PEA for validation.
